AGREEMENT FOR USE OF HYPERCAST SOFTWARE

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE DOWNLOADING OR USING THE SOFTWARE.  BY DOWNLOADING OR USING THE SOFTWARE, YOU ARE AGREEING TO ALL TERMS OF THE  AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS DO NOT DOWNLOAD OR USE THE SOFTWARE.

1. Use. The Multimedia Networks Group of the University of Virginia (hereinafter "We") gives you permission to download and use the HyperCast 2.0 software (hereinafter "Software") for the purpose of evaluating the Software, or, if you are an academic or non-profit institution, for the purpose of research or teaching. 

2. DISCLAIMER OF WARRANTY ON SOFTWARE. YOU EXPRESSLY ACKNOWLEDGE AND AGREE  THAT THE SOFTWARE IS AN UNSUPPORTED RESEARCH PROTOTYPE WHICH IS NOT SUITABLE  FOR USE IN SAFETY-CRITICAL OR ANY OTHER CRITICAL APPLICATIONS AND THAT THE  DOWNLOADING, INSTALLATION, USE AND DE-INSTALLATION OF THE SOFTWARE IS AT  YOUR SOLE RISK. THE SOFTWARE AND ITS RELATED DOCUMENTATION ARE PROVIDED  "AS IS" AND WITHOUT WARRANTY OF ANY KIND AND WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SHOULD THE SOFTWARE  PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING,  REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF  IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

3. Limitation of Liability. UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE, SHALL WE OR THE UNIVERSITY OF VIRGINIA BE LIABLE TO YOU FOR ANY INCIDENTAL,  INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF  BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION,  AND THE LIKE) ARISING OUR OF THE USE, MISUSE OR INABILITY TO USE THE  SOFTWARE OR RELATED DOCUMENTATION.
